General terms and conditions of the onlineshops

1. General remarks
The "Dachstein West ski region" is an association of the lift and piste operators named overleaf. The members "Dachstein West ski region" operate their respective cable cars and lifts as well as pistes at their own liability and on a legally independent basis. Insofar as below of the "Dachstein West ski region", this name also refers to the respective lift or piste operators. Online-tickets for the ski areas of the "Dachstein West ski region" entitle the customer to use the ski areas covered by the "Dachstein West ski region". Only persons aged 17 years or older are eligible to make purchases in our Online Ticketshop.

The General Terms and Conditions on hand apply to all services, bookings via the website www.dachstein.at as well as subshop-applications on partner websites and to electronic bookings for access authorization on non-contact data carriers (KeyCard) and in the enquiry system.

By using a valid online-ticket, a contract of transport and piste use is entered into with the respective lift or piste operator/s and the customer accepts the General Terms and Conditions of the "Dachstein West ski region". The use of the ski areas covered by the "Dachstein West ski region" and the use of the respective lifts or piste facilities are subject to the General Terms and Conditions of the "Dachstein West ski region".

2. Scope
The GTC apply to all current and future performances rendered in connection with bookings and the purchase of Online-Tickets with access authorization by customers online, via WEB-applications or other electronic media. In addition, the general tariff and carriage terms and conditions of the "Dachstein West ski region" apply.

3. Subject of the contract / online-Ticket
Subject of the contract is the electronic sale of data carriers for storing access authorization to lift or piste facilities for the "Direct-to-Access-Ticket reservation and Booking system" (DTA) of the SKIDATA AG. It is expressly pointed out that not all performances obtainable from the "Dachstein West ski region" can be booked online.

By purchasing an online-ticket, only the sale and activation of access authorizations (e.g. ski tickets) for the SKIDATA-control system available in the Dachstein West ski region in connection with electronic data carriers (KeyCards) is processed via the internet or other electronic media via the "Direct-to-Access-Ticket reservation and Booking system" (DTA).

Online-Tickets combined with the KeyCard named during online-purchase entitle the customer, as part of the scope booked online by him/her, to use the lifts and pistes - unless otherwise expressly stated - at specific dates indicated in the course of the online-purchase. Shifting the dates after conclusion of contract is not possible. Redeeming the online-ticket – unless otherwise expressly stated – is possible only on the selected date. Delayed redemption is not possible; the ticket will become invalid in this case.

The "Dachstein West ski region" reserves the right to change the specification of services and to inform the customer thereof in good time.

4. Special terms for electronic ordering procedure
4.1. Data entry
Booking is only possible after complete and correct entry of all mandatory fields in the booking window, as well as express acceptance of the GTC by means of the designated application in the booking window. Incorrect information in the Online Ticket Shop of the "Dachstein West ski region" shall result in revocation of the authorisation and exclusion from carriage without compensation. The customer is obligated to disclose any changes to his/her contact details (name, email and residential address) without delay.

4.2. Conclusion of contract
A successfully completed online booking constitutes an offer of contract by the customer to the "Dachstein West ski region". The customer acknowledges that the ordering process can no longer be cancelled or reversed once the button "Buy" has been pressed. Following confirming checking of the availability of the payment details provided by the "Dachstein West ski region", the booking request will be replied to in a booking confirmation by email. A conclusion of contract only comes about when the booking confirmation is received. In case of failure of the network connection, only the data captured by the "Dachstein West ski region" apply. There is no legal right to the advance booking bonus or similar, if the online booking, for whatever reasons, could not be completed within the advance booking time limit.

The electronic order confirmation (E-mail) by the "Dachstein West ski region" serves as the only permissible proof of a correctly completed booking, and is thus to be carried by the customer and produced together with the data carrier (KeyCard) in case of registering complaints.

4.3 Payment
Purchases in the Online Ticketshop are done by means of payment by credit card (Visa, Mastercard, or Diners Club) or instant transfer (Sofort AG). Online-Tickets can be redeemed only after full payment has been received.

Season tickets can be booked only with current photos. The KeyCard deposit is € 2.00 and will be collected together with the invoice amount when booking a KeyCard. All goods or products delivered remain in possession of the "Dachstein West ski region" until full payment has been made.

4.4 Booking processing
The "Dachstein West ski region" directly or indirectly uses various partners for the technological and financial processing of electronic bookings, including SKIDATA AG (www.skidata.com), and Elements (www.elements.at) and Starjack (www.starjack.at). These companies, however, do not enter into any direct contractual relation with the customer, unless such already exists due to another legal situation. In the course of the booking process, the customer may also be redirected to websites of these companies, the content of which the respective company is responsible for itself.

4.5 Shipping
When ordering a KeyCard, a delivery period by regular post (approx. 3-5 work days) is to be allowed for. The "Dachstein West ski region" assumes no liability for deliveries lost when sent by mail, or for KeyCards not received in time.

5 Withdrawal
The services provided by the "Dachstein West ski region" are recreational services, to be rendered at a specific date within a precisely specified period of time. The customer thus has no right of withdrawal (§ 18 Sect. 1 Z 10 Austrian Distance Selling Act FAGG in conjunction with § 11 Sect. 1 FAGG).

6. Data protection provisions
The customer grants express consent for the data provided by him/her to be forwarded, stored and processed for the purpose of transacting the booking and payment procedure to the database of the "Dachstein West ski region" and also to be matched with external systems for supervisory purposes. The customer equally agrees to these data being forwarded for the purposes of the statutory provisions and limitations of the Data Privacy Act 2000 to partners and members of the "Dachstein West ski region". The data will be deleted when the voucher has been redeemed as according to contract, or when the period of validity expires. The consent to such data being used can be withdrawn in writing at any time.

Your security is of the highest priority. Thus when paying by credit card, data such as credit card numbers, bank codes, account numbers, name and address will be transmitted via certified payment suppliers via their SSL connection in consideration of PCI guidelines.

The customer declares his/her express consent for the forwarding of the payment confirmation to the payment system – following its payment release – for debiting the respective invoice amount due by direct debit authorization with the selected payment method.

7. Uploading of existing data carriers
The customer is solely responsible for the correct entry of data, in particular the data carrier number. Incorrect entry may affect the functionality of the data carrier and ensues at the customer's risk. When topping up an existing KeyCard, the service booked can be used no sooner than 30 minutes after confirmation of completion has been received. From this time on, activation of the data carrier is categorically effective at all primary access points for the recreational facility booked.

The customer acknowledges that due to the required data transmission via the internet and via other data lines, problems may occur by way of exception when activating the data carrier, without this having any legal consequences, provided that it can be ensured in another way that the lifts can be used.

Any guarantee for faults when activating a functioning data carrier following correctly completed booking, is only provided by means of renewed attempt at topping up the data carrier locally by the personnel of the respective lift company or by issuing another suitable access authorisation. If the data carrier is not functioning, the customer must purchase a new data carrier if need be. If the booking process was not correct only due to entering incorrect or incomplete data carrier numbers, the booking can either be corrected with the help of the staff, or another access authorisation be issued. For all claims, the customer must produce the completion confirmation in any case, as otherwise any guarantee or free reissue of an access authorisation may be refused.

8. Choice of law / jurisdiction
These General Terms and Conditions apply insofar as they do not contradict applicable provisions of the Consumer Protection Act of the respective consumer state. Any ineffective provisions, however, shall not become invalid in full, but are to be limited to the nearest approximating, allowable content. The contractual language is German. Austrian law applies (with the exception of reference norms of international civil law and the UN Convention on Contracts for the International Sale of Goods). Competent court with subject matter jurisdiction – provided no legally mandatory jurisdiction exists – is the place of business of the respective lift or piste operator.

1. General
The "Dachstein West ski region" is an association of the lift and piste operators named overleaf. The members "Dachstein West ski region" operate their respective cable cars and lifts as well as pistes at their own liability and on a legally independent basis. Insofar as below of the "Dachstein West ski region", this name also refers to the respective lift or piste operators. Purchasing a ticket for the ski areas of the "Dachstein West ski region" entitles the customer to use the ski areas covered by the "Dachstein West ski region".

By using a valid ticket, a contract of transport and piste use is entered into with the respective lift or piste operator. By using a valid ticket, the customer accepts the terms of carriage, as approved by public authorities, of the lift and piste operator or facilities as posted and submits to the rules of conduct of the International Ski Federation (FIS).

Breaching the General Terms and Conditions or terms of carriage, as well as repeated failure to follow instructions by the piste/lift organisations, will result in exclusion from any further carriage / piste use and revocation of the ticket without substitution. Furthermore, the customer shall be obligated to pay a processing fee in the amount of EUR 70.00. The same applies in case of malicious damage to the "Dachstein West ski region" or defamatory and bankruptcy offensive conduct vis-à-vis piste and lift supervising bodies.

2. Tickets
Tickets are not transferable. Subsequent replacements or changes to the validity period of a ticket are not possible. Merely attempting to transfer a ticket without permission is regarded as a breach in terms of point 1. Every ticket holder has to store their ski pass in a way that prevents third parties from gaining access to it. Tickets and credentials for claiming special rates are to be produced to the piste and lift supervising bodies on request.

When purchasing a ticket, € 2.00 per ticket issued will be collected as deposit for the KeyCard. When returning the undamaged ticket to the cash point or the machine provided for this, this amount will be refunded.

Replacement in case of loss, theft or forgotten tickets (data carrier) is excluded. If losing a season ticket, a replacement pass will be issued against production of proof of purchase and ID; the lost card will be blocked. In case of a forgotten season ticket, a day ticket must be purchased at the respective daily rate. The forgotten season ticket will be blocked for this one day.

3. Refunds
Shutdowns of facilities, pistes or entire ski areas required due to weather conditions or other technical reasons, avalanche risk, early departure or disruption do not establish any claims for refunding of fees or extension of the validity period. If carriage is stopped for reasons caused by the passenger, no claim for refunding of fees or compensatory service shall exist. Limited provision of pistes and facilities does not justify any claims.

4. Rescue of injured persons
Insofar as rescue of injured persons is organised by the "Dachstein West ski region", the injured customer is to pay a rescue charges contribution. Outside of operating hours, the "Dachstein West ski region" cannot carry out the rescue of injured persons.

5. Piste reservations/special tours and special use
In general, pistes may be used in the same manner by all customers. Piste reservations and special tours are possible and allowed only with the express consent by the "Dachstein West ski region".

For unscheduled deployment of piste/lift supervising bodies or staff or snow groomers caused by the customer, the respectively applicable charge rates will be applied. For all deployments of equipment, a minimum of 20 minutes will be charged.

A fee will be charged for the transport of goods. Liability for transport damage is excluded. Animal transports also require the purchase of a ticket. Animals must be kept accordingly. In the ski and alp area, dogs must be generally kept on a leash, and muzzled during transport and in closed premises of all facilities.

6. Hours of operation
The ski slopes are - except those with night-time skiing - closed from 17:00 to 8:00 daily. During this time of closure, no dangers are guarded against and there is a significant risk of injury due to piste grooming, winch ropes, snowmaking and exposed cables and hoses.

7. Protection of the forest
Free accessibility of the forest requires a special sense of responsibility and obliges us to protect it. According to the Forestry Act, going downhill on winter sports gear in the forest and in the area of lifts is permitted only on marked pistes or ski routes. Leaving the groomed and demarcated routes and paths (e.g. also deep powder snow and mogul slopes) as well as using the adjoining forest areas is strictly prohibited and infringement is punishable (Sect. 33 Forestry Act). It is prohibited to enter forest cultures with less than 3 m tree height and to discard garbage and cigarettes. Any non-compliance will be reported and result in revocation of the ski pass entitlement without compensation.

8. Paragliders
Only pilots with a valid paragliding licence, registered aircraft with third-party liability insurance and a valid ticket are permitted to take off. Take-off and landing are permitted only on the areas marked for this purpose. Landing on all and any ski pistes is strictly prohibited. All statutory requirements for altitude and distance are to be observed. In case of infringement of these provisions, a ban on flying and/or carriage may be issued by the "Dachstein West ski region".

9. Liability
Any liability towards customers, be it due to contractual or statutory provisions, for incidents from or during the use of the lift and piste facilities, shall affect only those lift or piste operators in whose ski area such an incident occurs. No liability for other lift or piste operators shall be incurred.

The liability of the "Dachstein West ski region" for damage to property and financial losses, occurring in connection with using the lift and piste facilities, shall be excluded in case of slight negligence. The operators of the lift or piste facilities are in no way responsible for items lost by customers in the ski area. Any liability by the lift or piste operators in case of clothing being soiled when using the cable cars and lifts is excluded in any event.

10. Non-liability Booking platform
The "Dachstein West ski region" merely makes available on its booking platform the metasearch engine for the brokering of offers and demand for accommodation providers in Inner Salzkammergut in Upper Austria and Tennengau in Salzburg. The "Dachstein West ski region" shall not be liable for the accuracy, completeness and satisfiability of the bookings/reservations made via the booking platform, in particular also not for the accuracy of the final price generated. All prices on this booking platform are nonbinding recommended prices.

11. Paid and promotional activities
All paid and promotional activities on facilities, pistes and ski slopes as well as parking areas (e.g. mounting billboards, panorama cameras and other advertising) of the "Dachstein West ski region" requires prior written consent. Noncompliance shall result in exclusion from carriage and revocation of the ticket.

12. Data protection provisions
By purchasing a ticket, the ticket holder agrees to photographic capturing, storage and processing at the point of sale of tickets and points of access for supervisory purposes so as to prevent the improper use of tickets. The customer grants express consent for the data provided by him/her to be forwarded, stored and processed for the purpose of transacting the booking and payment procedure to the database of the "Dachstein West ski region" and also to be matched with external systems for supervisory purposes. The customer equally agrees to these data being forwarded for the purposes of the statutory provisions and limitations of the Data Privacy Act 2000 to partners and members of the "Dachstein West ski region". If the tickets are used as according to contract, the data will be deleted when the period of validity expires. The consent to such data being used can be withdrawn in writing at any time.

The customer also has the option of submitting the required information via a safeguarded data transfer (SSL). On the part of the companies involved, forwarding – at least of the data necessary for payment transaction – is done by secure data lines at all events. The customer declares his/her express consent for the forwarding of the payment confirmation to the payment system – following its payment release – for debiting the respective invoice amount due by direct debit authorization with the selected payment method.

13. Choice of law and jurisdiction
These General Terms and Conditions apply insofar as they do not contradict applicable provisions of the Consumer Protection Act of the respective consumer state. Any ineffective provisions, however, shall not become invalid in full, but are to be restricted to the nearest approximating, allowable content. The contractual language is German.
